Truck Driver Who Caused Tracy Morgan’s Accident Says Tracy Already Has Enough Money

Screen Shot 2014-12-12 at 5.10.28 PMThe Walmart truck-driver who hit comedian Tracy Morgan’s limo on June 6 and left him fighting to regain full brain usage has finally spoken up. But not in remorse.

Kevin Roper is apparently upset that Morgan is suing Walmart, claiming that the actor has enough money since he was in a limo at the time of the accident, according to TMZ.

Morgan and the others in his camp involved in the crash are suing Walmart for negligence, claiming that Roper’s sleep deprivation due to his schedule as a long-haul truck driver contributed to the accident.

Roper has asked that this civil case be put on hold until after the criminal case for the death of comedian James McNair in the accident has finished. Morgan, however, wants to go ahead with the case because he needs the money from the judgement.

In legal documents, Roper has alluded to the fact that Morgan’s financial woes don’t come close to his, according to reports.

Since the accident, Morgan has been fighting to make a full recovery.

“He’s fighting to get better, and if there’s a chance for him to be back to the Tracy Morgan he once was, he’s going to try to do that,” his lawyer Benedict Morelli said. “But we just don’t know because of the severity of the injuries that he sustained and the fact that he had such a severe brain injury.”

In September Walmart made claims that some of the injuries sustained could have been prevented if the injured people had been wearing seat belts.

“After I heard what Walmart said in court I felt I had to speak out,” Morgan said in response. “I can’t believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I’m fighting hard every day to get back.”

  6. Christina, it wouldn't have mattered whether he was wearing a seat belt if the limo had not been hit. It has nothing to do with Tracy or his friend who was killed but everything to do with the driver of the truck and him falling asleep at the wheel.

    You dropped a cover ('…book by the cover') you didn't associate the book with the subject matter. You left the title hanging by itself which had no meaning standing on its own. No doubt, it's probably a really good book (I was going to look it up) and it's nothing wrong with multi-tasking but include with explanation. I'm not upset just concerned. I like Tracy Morgan and want justice for him, his associates, family & friends like everyone else.

Joseph Scott Jr. wal-mart doesn't force anyone to drive a truck, the driver had just come back from being off duty which means he decided not to catch up on his rest. as a driver you get 70 hours drive time within a week with scheduled rest periods, when you hit the 70 hour mark you have to take a mandatory 34 hour off duty period before you can drive again. This driver apparently used his off duty time for everything but rest and got back behind the wheel tired. The drivers fault, not Wal-marts

    Truck drivers are governed by DOT Regulations. It is up to the driver to keep a on/off duty log. If u r stopped by DOT and ur log ain't right, guess what, u CAN'T blame it on your employer because it is YOUR responsibility as the driver to know when u r "available" for duty. It doesn't matter, black/white, male or female ALL drivers SHOULD be following DOT regs. You severely injure or kill someone because U were too tired to drive, best believe that employer will ctoa (cover their own azz) and simply state that according to what u told them u were ready to drive. Your statement is like saying what people do does not reflect on their employer while they are on the clock getting paid by said employer. Companies that interface with the public are required to be insured, as well as carry error and omission insurance. So if he didn't handle his business appropriately, Wal-Mart has a very high level of culpability in the accident. That is why they are being sued. If the driver is independent the law suit is a deep pockets strategy destined to fail regarding Wal-Mart. However, the independent insurance company is on the hook.

  60. I've worked at wal-mart as well as other places like lowes and I know about the "daily" driving limit. I also know how it can be altered by management to look like he wasn't on the road that whole time so they can go past the limit.

Companies have insurance because people die or get injured, products get spoiled due to equipment malfunction and drivers make errors. But as a driver I'm just saying there's no way to monitor an employees time at home. So the driver was not in violation of the D.O.T. laws and was legal to drive. So it's negligent on the driver at this point. But still in all WALMART WILL PAY. The driver is going to jail. I know what I'm talking about. But my opinions end there…

  85. Joseph. Off Duty is your time so ya he may have parted to long an not slept. I drove for 32 years an when I felt sleepy I stopped an yes I pushed it to the limit at times. He was pushing it because he couldn't stop cause if he did he would be FIRED for being late, The driver made 2 mistakes (1) Trying to be on time an (2) working for this worthless company. An I'm not logically speaking I'm stating a fact. So yes it is the drivers fault BUT Wal Mart should not have put him in that predicament.

I would like to point out to you that the Federal Motor Carrier Safety Administration writes DOT regulations that state: "The Hours of Service rule for truck drivers contains an 11-hour daily driving limit and 14-hour work day limit." Most, if not all States harken to federal safety laws when it comes to interstate driving.

    The driver won't go to jail, he'll just loose his CDL. He'll get probation at best (manslaughter). Even thought he is wrong for driving tired, he did not intend to kill or cause injury to anyone. He intended on making a delivery.. So in that case if all the facts are out and not based on public opinion this is what will happen.

    Its 11 hrs driving 14 hrs on duty and a 10 hr break after 14 hrs unless u do a split sleeper then 8 hr break is required but u get less driving time back
