“Only real music is gonna last. All the other bulls— is here today and gone tomorrow.” Wise words from a wise man.

Who was that man? Late jazz singer Jimmy Smith, whose voice was sampled by Drake on his hookup with Jay Z on “Pound Cake/Paris Morton Music 2.”

The 35-second monologue helps set up tales of both men’s epic successes and is one of the highlights of “Nothing Was the Same.”

There’s just one problem: Smith’s estate argues in a lawsuit that despite claims in the album’s liner notes that Drake’s team legally sampled the bit from the 1982 song “Jimmy Smith Rap,” the proper license wasn’t obtained.

According to TMZ, no permission was ever given to use the snippet, and now Smith’s estate is seeking more than $300,000 in compensation from Drake, the Cash Money record label and others. A spokesperson for Drake could not be reached for comment on the suit.
