Halle Berry’s ex Gabriel Aubry has been released from jail following a brawl with Berry’s fiance Olivier Martinez. Aubry’s bail was paid by bondsman David Perez and Perez picked him up from the LAPD around 6 p.m. Thursday evening. Aubry has been charged with misdemeanor battery and has been ordered to stay 100 yards away from Berry, Martinez and Nahla, his and Berry’s 4-year-old daughter.
According to TMZ, the fight started in Berry’s driveway when Aubry dropped Nahla off at her mother’s house on Thanksgiving and Martinez walked over to him and said “We have to move on.” Apparently, Aubry didn’t like that and proceeded to push and throw a punch at Martinez. Martinez blocked the punch but Gabriel ended up pushing him onto the ground. According to witnesses, Martinez was able to recover and punched Aubry in the face. After a struggle, Martinez was able to pin Aubry to the ground and the police were called. Martinez made a citizen’s arrest and both men were eventually taken to the ER. Martinez allegedly suffered neck injuries and a broken hand while Aubry got the worst end of the fight with a bruised face, a broken rib and an unspecified head injury. Aubry was taken into police custody after he was discharged from the hospital.
It is unclear whether or not Nahla witnessed any of the fight but according to the Daily Mail, her mother rushed her inside of the house as the conflict began. Details of the argument are also unclear since a lot of the nasty words were exchanged in French, unsurprising since Aubry is French-Canadian and Martinez, whose father is Spanish, is a native of France. This fight is just another addition to the saga surrounding Berry and Aubry. The two ended their relationship in 2010 and have been locked in a custody battle over their daughter ever since. Earlier this month, Aubry scored a win in the battle after Berry was denied permission to move Nahla to France.
