(1) There was no illegal sale of cigarettes being performed, the police simply acted on heresay, something which, in court, is inadmissible,
(2) With no probable cause, the police officers had absolutely no business in detaining him or attempting to arrest him, and
(3) The fact that he told the police that he could not breathe eleven times while he was hardly moving would by all common sense compel the police officers in question, especially the one in charge as a matter of health, to re-position themselves so that another human being could breathe.
But Eric Garner wasn't white, and that's the ONLY fact that you are looking at or concerned about.
