Victoria's Secret Faces $15M Lawsuit

Victoria’s Secret Lawsuit: Victoria’s Secret has dominated the lingerie business for many years but not without its fair share of controversies, the latest, a $15M lawsuit.

Former hosiery supplier, Zephyrs accused Victoria’s Secret of selling inexpensive “knockoffs” in a $15 million lawsuit. Zephyrs alleges that Victoria’s Secret and parent company, Limited Brands Inc. breached a 2001 contract, selling legwear with Zephyrs-designed images on the packaging. The lawsuit was filed on August 10 in Columbus, Ohio, where Victoria’s Secret is headquartered. In addition to breach of contract accusations, the suit requires Victoria’s Secret to correct the false packaging and in-store displays.

Zephyrs’ lawyer Joseph Gioconda explained to WWD, “Victoria’s Secret changed the product in the packaging but didn’t change anything except Made in Canada on the back of the package. It used to say Made in Italy.”

After numerous email and phone attempts to reach Victoria’s Secret senior management, Zephyrs’ owner, Debra Mackinnon received no reply except when forcing her to sign a new master sourcing agreement, which would essentially put Zephyrs out of business. With her businesses’ best interest in mind, it is unlikely Mackinnon will sign such a contract.

Between their recent Bond Street store controversy, an un-airbrushed photo leaking, and today’s announced lawsuit, Victoria’s Secret has some major public relations cleanup on their hands this year.
