NJ Company Claims Victoria’s Secret Selling Counterfeit Products, Files Suit

Is Victoria’s Secret pulling the stockings over its customers eyes?

A lawsuit has been filed against the lingerie maker that could potentially mean losses to the company of hundreds of million dollars.

A New Jersey-based retailer of Italian hosiery company called Zephyrs filed the suit, claiming that when Victoria’s Secret stopped using Zephyrs as its supplier of thigh high stockings and switched over to a cheaper product that Zephyrs alleges is of lower quality, Victoria’s Secret didn’t change the packaging and in-store displays that show the Zephyrs product. The only thing the company changed was replacing the “Made in Italy” label with “Made in Canada,” Zephyrs alleges.

The $15 million lawsuit filed by Zephyrs against Victoria’s Secret and its parent company, Limited Brands, accuses the popular brand of breach of contract, unfair competition and false advertising.

Lawyer Joseph Goiconda, whose firm represents Zephyrs, said his client is also seeking “corrective advertising” and a recalled of the products—which could mean close to 100 million counterfeit stockings.

The lawsuit was filled on August 10, but the complaint was unsealed on Friday after efforts to reach a settlement proved unsuccessful. Victoria’s Secret has not yet responded to the allegations.
